2. Scope and Definitions

For the purposes of this Legal Notice, the following terms apply:

“Website” means the public website located at www.resnova.io, used for informational and marketing purposes.
“Client” means an organisation that has engaged Leonardo Esuri, Sociedad Limitada to provide consulting or advisory services under an engagement letter, master services agreement, or non-disclosure agreement.

This Legal Notice governs only access to and use of the Website. Access to and use of the Website does not extend to personal data or materials that Leonardo Esuri, Sociedad Limitada receives from a Client in the course of a consulting engagement — that is governed exclusively by the terms agreed with the Client, not by this Legal Notice. In the event of any conflict between this Legal Notice and the terms of a specific engagement agreement with a Client, that engagement agreement shall prevail in relation to matters it governs.

3. Purpose

This Legal Notice governs access to and use of the website https://resnova.io (the “Website”), owned by Leonardo Esuri, Sociedad Limitada, trading as Resnova. Access to and use of the Website implies acceptance of this Legal Notice.

The Website is informational in nature. It does not process, store, or transmit materials shared with Leonardo Esuri, Sociedad Limitada by a Client in the course of a consulting engagement — that exchange takes place outside the Website, under the terms of the applicable engagement agreement.

4. Conditions of Access and Use

Access to the Website is free of charge, except for the cost of the telecommunications connection through the network supplied by the access provider contracted by the user. Use of the Website requires full, unreserved acceptance of all provisions included in this Legal Notice.

Any individual accessing the Website on behalf of an organisation represents that they are authorised to act on that organisation’s behalf. The Website is intended for use by professionals and organisations evaluating or using Resnova’s services, and is not directed at individual consumers.

5. Intellectual and Industrial Property

All content on the Website — including text, images, logos, designs, source code, and software — is owned by Leonardo Esuri, Sociedad Limitada or used under license, and is protected by intellectual and industrial property laws. Reproduction, distribution, or public communication of this content without prior written authorisation is prohibited.

This Legal Notice does not govern intellectual property rights in deliverables, reports, or analyses produced for a Client in the course of a consulting engagement. Ownership, licensing, and permitted use of such deliverables are governed exclusively by the terms of the applicable engagement agreement.

6. Limitation of Liability

Leonardo Esuri, Sociedad Limitada does not guarantee that the Website will be free of errors or interruptions, or that its content is complete or up to date at all times. To the maximum extent permitted by applicable law, Leonardo Esuri, Sociedad Limitada shall not be liable for damages of any kind arising from access to, or the impossibility of accessing, the Website, including but not limited to damages caused by computer viruses, malicious code, or technical malfunctions beyond its reasonable control.

This limitation applies solely to the Website. It does not limit, exclude, or otherwise affect any liability, warranty, service commitment, or obligation of Leonardo Esuri, Sociedad Limitada arising under an engagement letter, master services agreement, or other contract governing a consulting engagement, which are negotiated and stated separately with each Client.

7. Hosting Provider

This Website is hosted by Hetzner Online GmbH (Germany), on server infrastructure located within the European Economic Area.

Content delivery, DNS and security services for the Website are provided by Cloudflare, Inc. (United States). Details of the personal data processed by these providers, and of the safeguards applying to any transfer of personal data outside the European Economic Area, are set out in the Privacy Policy.

8. Applicable Law and Jurisdiction

This Legal Notice is governed by Spanish law. Any dispute arising from access to or use of the Website shall be submitted to the Courts and Tribunals of Huelva, Spain, unless mandatory consumer protection law provides otherwise.

This clause governs disputes relating to the Website only. Disputes arising from the commercial relationship between Leonardo Esuri, Sociedad Limitada and a Client under a consulting engagement agreement are governed by the law and jurisdiction specified in that agreement, which may differ from this clause where the Client is domiciled outside Spain.

9. Data Protection and Privacy

9.1 Role as data controller (Website)

For personal data collected through the Website — for example via contact forms, newsletter subscriptions, or website analytics — Leonardo Esuri, Sociedad Limitada acts as data controller. Such data is processed in accordance with the Privacy Policy, which sets out the purposes of processing, legal bases, retention periods, and the rights available to data subjects under the GDPR and Spanish Organic Law 3/2018 on Data Protection and Guarantee of Digital Rights (LOPDGDD).

9.2 Role as data processor (Consulting Engagements)

Where Leonardo Esuri, Sociedad Limitada processes personal data on behalf of a Client in the course of a consulting engagement — for example, personal data contained in materials a Client shares for capacity sourcing, product design, or regulatory application support — that processing is governed by the terms agreed with the Client (including any data processing terms in the engagement agreement), and is not governed by this Legal Notice or by the Privacy Policy referenced in Section 9.1.

9.3 Privacy contact

Leonardo Esuri, Sociedad Limitada has not formally appointed a Data Protection Officer, as this is not currently required given the scale and nature of its processing activities as data controller of the Website.
